These Terms of Use govern the Moonshot macOS app and moonshot.fyi. “Moonshot,” “we,” and “us” refer to 21 Media LLC. Please read them; the headings are a map, not a substitute.

01Acceptance

By downloading, installing, accessing, or using Moonshot, you agree to these Terms. If you use the Service on behalf of a company or team, you represent that you have authority to bind that organization, and "you" includes that organization.

If you do not agree to these Terms, do not use the Service.

02The Service

Moonshot is a macOS screenshot and screen recording app. It lets you capture screenshots and recordings, save them locally, optionally upload encrypted captures to Moonshot Cloud, create share links, manage a cloud library, and use paid plans and team collaboration features where available. Depending on your plan, share pages can include interactive elements you configure (links, cards, end screens, email capture), auto-generated chapters, and viewing analytics that show you how your recording was watched.

Moonshot is not a backup service, records-management system, emergency service, or long-term archival storage product. You are responsible for keeping independent backups of content you need to preserve.

03Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with permission from a parent or legal guardian.

04Your Moonshot Identity and Keys

Moonshot creates a local identity and secret access key on your device. The app also creates recovery information used to restore access to your cloud library.

You are responsible for protecting your device, secret access key, recovery file, dashboard sessions, and share links. Anyone with the right recovery information or a valid share link may be able to access or decrypt your content. Moonshot may not be able to recover encrypted cloud library data if you lose your recovery information.

05Your Content

You keep ownership of screenshots, recordings, files, comments, reactions, transcripts, names, invite information, and other material that you capture, upload, submit, post, share, or otherwise provide through the Service.

You grant Moonshot a limited license to host, store, transmit, and display Your Content and related metadata only as needed to provide, secure, and maintain the Service for you, enforce these Terms, and comply with law. We do not use Your Content for advertising, to build profiles, or to train AI models.

You represent that you have all rights and permissions necessary to capture, record, upload, share, and process Your Content.

06Encryption and Sharing

Moonshot is designed to encrypt uploaded screenshot and recording content before it leaves your Mac. Moonshot Cloud is designed to store encrypted media rather than readable screenshots or recordings.

Encryption does not make every part of the Service invisible to Moonshot. Moonshot collects as little information as reasonably possible, but may process account identifiers, upload metadata, share metadata, team records, invite emails, comments, reactions, transcripts, chapters, viewing analytics, product telemetry, usage data, billing records, support communications, and operational logs as needed to run the Service.

Do not upload or share content unless you are comfortable with the access settings and the risk that recipients may copy, download, record, forward, or otherwise disclose it.

07Plans, Billing, and Storage

Moonshot may offer free and paid plans. Paid subscriptions are processed through Stripe. By purchasing a paid plan, you authorize recurring charges according to the checkout terms shown at purchase. Taxes may apply.

You can manage or cancel subscriptions through the billing tools we provide. Unless required by law or expressly stated by us, fees are non-refundable and cancellation stops future renewal rather than refunding past charges.

Team plans include pooled workspace storage for normal collaborative capture, review, and sharing workflows. Moonshot is not intended for archival backup, automated bulk upload, CDN use, or file-hosting abuse.

08Acceptable Use

• Do not violate law, contracts, intellectual property rights, privacy rights, publicity rights, or confidentiality obligations.
• Do not capture, upload, or share content without required rights or consent.
• Do not harass, threaten, abuse, exploit, or harm others.
• Do not store or distribute malware, phishing content, credentials, secrets, or materials intended to compromise systems.
• Do not interfere with, reverse engineer, overload, scrape, crawl, probe, or attack the Service or its infrastructure except where law expressly permits security research.
• Do not bypass storage limits, access controls, billing systems, rate limits, or security measures.
• Do not use the Service as bulk archival storage, automated backup storage, content delivery infrastructure, or a file-hosting abuse platform.

We may investigate suspected violations and may remove content, restrict sharing, suspend access, or terminate use where we believe it is appropriate.

09Share Analytics, Email Capture, and AI Features

Share pages collect viewing analytics for you, as described in the Privacy Policy: views, watch progress, which parts of the timeline were played, and clicks on elements you configured. If you enable email capture, viewers may submit their email address to you through your share page.

You are responsible for how you use this information. If you contact people who submitted an email address, you must comply with applicable marketing, consent, and data-protection laws. If your organization requires notices or consents before you collect viewing information from your audience, you are responsible for providing them.

AI features (transcription, summaries, chapters, and AI actions) process the relevant content with our AI infrastructure provider to produce the output you requested. AI output can be wrong or incomplete; review it before relying on it or sending it to others. AI features are subject to plan availability and fair-use limits.

10Team Workspaces

Team owners and administrators may manage team names, members, invites, roles, billing, and shared workspace content. If you join a team, your activity and content associated with that team may be visible to team members or administrators according to product features and role settings.

You are responsible for managing team membership and permissions, including removing members who should no longer have access.

11Third-Party Services

The Service may rely on third-party services such as hosting/storage infrastructure, Stripe, email delivery providers, operating-system services, browsers, and font or infrastructure providers. Third-party services are governed by their own terms and policies.

12Software License

Subject to these Terms, Moonshot grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Moonshot app for your personal or internal business purposes.

You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works of the app or Service except as allowed by law or by a separate written agreement with us.

13Privacy

Our Privacy Policy explains how we collect, use, disclose, and protect information. By using the Service, you acknowledge the Privacy Policy.

14Suspension and Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service, remove content, or disable sharing if we believe you violated these Terms, created risk for the Service or others, failed to pay fees, or used the Service in a way that may cause legal, security, operational, or reputational harm.

15Disclaimers and Limitation of Liability

The Service is provided "as is" and "as available." To the maximum extent permitted by law, Moonshot disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, reliability, security, and error-free operation.

To the maximum extent permitted by law, Moonshot and its affiliates, officers, employees, agents, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, goodwill, data, content, or business opportunities.

To the maximum extent permitted by law, Moonshot's total liability for all claims relating to the Service will not exceed the greater of the amount you paid to Moonshot for the Service in the 12 months before the claim arose or USD
